Michigan Municipal League Opposes Latest 'Fix' to Gag Order Law

League Continues Call for Repeal of Section 57(3) of PA 269

LANSING, Michigan — The Michigan Municipal League continues to oppose the latest version of HB 5219, following House passage today.

“It has been repeatedly pointed out the new law addresses a non-existent issue,” said Chris Hackbarth, state affairs director for the League. “Out of the hundreds of local ballot questions presented since 2012, there were only a handful of violations related to a local ballot question.”

In an attempt to fix the new law’s language that has been temporarily enjoined by the U.S. District Court for vagueness, HB 5219 continues to lack the clear guidance in how a public body can communicate with its residents about local ballot questions.

“The best solution to address this poor public policy continues to be repealing Section 57(3) of PA 269 all together,” Hackbarth said.
