The House Intergovernmental Committee today reported two bills – HB 5211 and 5212 – that include transportation and transportation-oriented development as part of planning and zoning. The laws currently have a list of things that need to be reviewed when a master plan or zoning ordinance is reviewed and updated, including location, character, extent of streets, railroads, airports, bike paths, etc. The original version of HB 5211 would have required transit and TOD review in site plans, but the League objected to that as a new expense and as the state inappropriately getting involved in site planning. Rep. Donigan, sponsor of the bills and Chair of the committee, agreed to change the language to be part of the natural review that communities must do of the master plans and review of the zoning ordinances. The League supported this version of the legislation.
