The Legislature has sent to the Governor SB 284 which would allow exemptions from the Incompatibility of Office law for elected officials who want to serve on a Corridor Improvement Authority, Metropolitan District, Neighborhood Improvement Authority, Water Resource Improvement TIFA, Historical Neighborhood TIFA, Principal Shopping District, Business Improvement District, an officer of a Metropolitan District, or a Land Bank. Current law alread provides exemptions for DDA’s, Brownfield Authorities, LFDA’s and TIFA’s. This bill was sponsored by Sen. Gerald Van Woerkom (R-Muskegon) and supported by the League. It will allow officials to provide a needed nexus between these boards and the local government. It will also assist communities that cannot populate these boards because of a lack of volunteers. A League-requested amendment was added in the process to also include Housing Commissions. The bill now goes to the Governor, who is expected to sign the legislation.
