We understand that public transit agencies are receiving notice from the U.S. Deptartment of Labor (USDOL) regarding PA 4 (emergency manager law), PA 54 (prohibits retroactivity) and PA 152 (new health care requirements).

The USDOL has taken administrative notice of these statutes and is reviewing them. Federal transit law prohibits the Secretary of Labor from certifying a grantee's employee protection agreements if collective bargaining rights are diminished or taken away.

At this time, our understanding is that no official determination has been made yet by the USDOL. We understand the Governor's office is working with the Deptartment, and we are continuing to monitor this issue. Until an official determination has been reached, there is no immediate impact to transit funding. We will continue to keep you updated as this moves forward.
