This morning the Senate Reforms, Restructuring and Reinventing Committee hear testimony on HB 4059, a bill that would prohibit "union activity" during time paid for by a public employer.

Many public employer and union groups discussed problems with this language. The chair indicated there would be an additional hearing next week with an intent to vote on the bill at that time.

Iin passing its version of 2013 spending for a number of departments and programs (H.R. 5326), the House has voted to maintain current 2012 spending levels for the COPS (Community Oriented Policing Services) program.
The bill also includes increased funding for Byrne Justice Assistance Grants and Second Chance grants.
While a major victory since the bill when it came to the floor included significant cuts, the bill has a long way to go as no one expects spending bills for 2013 to be completed until after the election. Still, this sends a strong signal that there is continued support for these community based programs.

Yesterday the House Judiciary Committee passed HB 5466, a bill that would expand the anti-indemnification statute to apply to construction contracts with public entities.
The bill would prohibit an indemnification agreement between a public entity and a contractor if the agreement deals with the design, construction, alteration, repair or maintenance of a structure.
The League testified with concerns about the legislation, mainly that we interpret this to eliminate liability of a contractor when a subcontractor under their control is at fault.
The legislation passed committee unanimously, but we are pushing for amendments to be added on the House floor.

Yesterday the Senate passed three bills that would address issues with medical marijuana.
Senate Bill 505 would prohibit an individual from being a caregiver if he or she has been convicted of a felony. SB 321 would prohibit medical marijuana use from being covered by personal injury protection (PIP) in an auto insurance policy.
The Senate also passed SB 933, a bill that allow employers to not reimburse charges for medical marijuana treatment under workers compensation. The bills now head to the House for consideration.
